New York's Appellate Division, 2nd Department, has clarified how courts should approach applications for attorney fees by lawyers who have been disbarred. The opinion dealt with possible fees owed to a personal injury attorney who was disbarred for conduct unrelated to the case in question. The court held that a disbarred, suspended or resigned attorney "may be compensated on a quantum meruit basis for legal services rendered" prior to the effective date of disbarment, suspension or resignation.
