A New York jury on Thursday rejected a widow's claim that her husband's death resulted from events triggered by a Benihana hibachi chef playfully tossing a piece of hot shrimp at him. Jerry Colaitis' family alleged that he injured his neck while avoiding the flying food, and that he ultimately died from infection six months after a second surgical procedure. The jury deliberated for two hours before finding unanimously that the restaurant was not responsible. The widow's attorney said an appeal is unlikely.

A jury Thursday rejected a widow’s claim that her husband’s death was caused by a piece of hot shrimp playfully tossed at him by a Japanese steakhouse chef.
The jury of five men and one woman deliberated for barely two hours before rendering the unanimous verdict, ending the 16-day trial of Estate of Colaitis v. Benihana Inc., 015439-2002, before Nassau County Supreme Court Justice Roy S. Mahon.
