Ed Porter claims the 2005-06 guidebook cover image was from one of his photographs and he wasn't given any attribution. A foundation attorney argues that Porter's copyright has not yet been issued and that the photo doesn't meet the legal definition of a work of art.

Ed Porter of Fort Smith, Ark., filed the suit in November, accusing the foundation of copyright infringement because he says the cover image used for the 2005-06 guidebook was from one of his photographs and he wasn’t given any attribution.
