Only the 8th U.S. Circuit Court of Appeals permits multiple convictions for a single act of illegal firearms possession, but now two appellate judges have called for the full court to reconsider its position as an outlier among the circuits. The appeal stems from the case of Earnest J. Richardson, who was found by Minneapolis police with a single firearm and convicted of being a felon in possession of a firearm and a drug addict in possession of a firearm.

Judge Michael J. Melloy and Senior Judge Gerald W. Heaney, who both sit on the 8th Circuit, also took the government to task for arguing conflicting positions from circuit to circuit on this issue.
