A Pennsylvania Superior Court panel has upheld $20 million in compensatory damages awarded to a student who suffered brain damage after hospital staffers allegedly were slow to respond to a clogged tracheotomy. Defense lawyers argued the jury had mistakenly included punitive damages in its malpractice award. Attorney Stephen Cozen said he would appeal to the state Supreme Court. "You don't think that the $20 million didn't already include punitive damages?" he asked. "I mean, please, give me a break."
