In May, they shut down Smith's flagship company, Xpress Pharmacy Direct, suspected of being part of a massive unsolicited e-mail marketing campaign. Seen as one of the world's leading spammers, Smith remains free on bail as he awaits a hearing Thursday on contempt-of-court charges for which prosecutors are seeking six months in jail. He also faces a grand jury investigation.
