Earlier this month, Supreme Court Justice Antonin Scalia could barely contain his contempt for the Court majority when it invoked international consensus to support its view that the juvenile death penalty is unconstitutional. The domestic violence case of Castle Rock v. Gonzales , set for argument Monday, might not seem to lend itself to the same sort of analysis. But one amicus curiae brief asks the Court in no uncertain terms to look again to treaties and international law.
