The issue of diversity jurisdiction, a hot topic in the class action reform debate, is now on its way to the Supreme Court in Roche v. Lincoln Property Co. The 4th Circuit's holding in the case -- which is in line with the 7th and 9th circuits -- turned on the definition of a corporation's citizenship, and could foreclose the option of the alternate federal forum for certain business entities. The Court will consider granting certiorari to Roche at its conference Friday.
