In a decision that could fundamentally alter the way civil rights claims are litigated, a Philadelphia judge has ruled that alleged victims of police abuse can pursue their claims solely under the Pennsylvania Constitution, and need not always resort to a federal claim under �1983. The ruling was the first Pennsylvania decision to address the question, but was consistent with a strong national trend -- 13 other states have recognized such rights under their constitutions.
