In February 2000, George Couto, a marketing manager at Bayer, filed a whistleblower suit against the company, alleging it had defrauded the government by failing to report a discounted price for its sale of the drug Cipro to Kaiser Permanente. Because Couto helped implement the plan, the suit highlights a controversial aspect of the False Claims Act, which lets whistleblowers collect up to 30 percent of any recovery, even if they were complicit in the fraud.
