In its most extensive discussion to date of the Federal Trademark Dilution Act, the 3rd U.S. Circuit Court of Appeals has ruled that the publishers of The Sporting News are entitled to an injunction that bars another publisher from using the name Las Vegas Sporting News.
By a 2-1 vote, the court found the new law can be applied to “niche markets” and that the lower court did not err by concluding that The Sporting News mark was “famous” in the sports periodicals market.
