An employee was not subjected to disparate treatment when he was fired for selling marijuana on his employer's premises while the co-workers he sold it to -- and who smoked it on the job -- were not, the Pennsylvania Commonwealth Court ruled. The court said the employer had good motives for retaining the other employees because they assisted in the investigation that led to the claimant's termination.
