Non-profit corporations can claim damages for lost business opportunities, just as for-profit corporations can, New York’s Appellate Division, First Department, ruled Tuesday in a case of first impression.
A unanimous panel of four justices, led by Justice Ernst H. Rosenberger, said that since non-profits receive income, they can suffer lost opportunities to gain income.
