A Texas judge hit the Burlington Northern Santa Fe Railway Co. with $10 million in sanctions, charging the railroad used "false" and "concocted" evidence during a wrongful death trial. Tarrant County District Judge Robert McGrath ordered a mistrial and indicated he will turn over his charges of evidence tampering to the county prosecutor's office. The plaintiffs will receive $5 million of the $10 million in fines, and $5 million will go to the Texas Center for Legal Ethics and Professionalism.

A Texas judge has hit the Burlington Northern Santa Fe Railway Co. with $10 million in sanctions, charging that the railroad used “false” and “concocted” evidence during a wrongful death trial.
Tarrant County District Judge Robert McGrath also ordered a mistrial and fined the lead defense counsel $10,000 for saying that he believed Burlington had not engaged in any sanctionable conduct.
