A federal judge dismissed a lawsuit filed by a woman who claimed a police officer had a duty to arrest her for a DUI. Jacqueline Wyatt was stopped by New Castle County, Del. police officer John Krzysiak for speeding. Krzysiak gave Wyatt alphabet and counting tests, both of which she passed, so he let her go. Minutes later, Wyatt collided with a truck and was badly hurt. She sued Krzysiak, saying he should have known she was intoxicated when he stopped her.
