A federal judge in Philadelphia refused to disqualify attorney Marvin Barish as plaintiff’s counsel in the upcoming re-trial of a personal injury case, finding that such a sanction would be too harsh a punishment even if Barish committed an ethical violation by paying the plaintiff’s rent, gas, electric, cable television and phone bills since November 1997. In the motion, defense attorney Robert B. White Jr. argued that Barish violated one of the Pennsylvania Rules of Professional Conduct which prohibits a lawyer from providing financial assistance to a client other than expenses of litigation. “There’s no right on our part to seek reimbursement, and, therefore, there’s no conflict of interest and therefore there’s no rule violation,” Barish responded. Barish’s firm has been paying rent of $729 per month for the Shade family for almost two years now, White noted. With the other living expenses covered by the firm, White said, Barish has probably paid out more than $20,000.
