A claimant will have to refund employer benefits he was overpaid as a result of the employer’s miscalculation, an en banc Commonwealth Court has ruled in a decision it admitted was “unusual.”

The majority claimed that its decision was directed by provisions in the Workers’ Compensation Act allowing both employers and employees to request a modification of a notice of compensation payable if a mistake has been made.
