The California Supreme court recently upheld MCLE against an equal protection challenge in Warden v. State Bar, but is anyone scrutinizing the worth of CLE programs currently being offered? George M. Kraw, a San Jose attorney writing for California Law Week, doesn’t think so. “Purveyors of meditation classes, weight reducing seminars, field trips to Belize and local bar courses on How to Get High Without Getting Arrested can rejoice in their curricula’s reaffirmation as continuing legal education,” he wrote. “Psychologists, therapists, yoga instructors and miscellaneous New Age gurus can still morph into State Bar-vetted lawyer educators.” Kraw asks, along with the critics, how exactly does a program that forces lawyers to pay for and spend time in “professionally irrelevant” courses protect consumers? Good question.
