The California Supreme Court agreed Wednesday to settle a question that has nettled cities ever since the passage of Proposition 209: Does the anti-affirmative action initiative also ban minority outreach programs -- programs that merely seek to encourage minorities to apply for public contracts, without actually giving them a leg up in the bidding process? Cities in favor of such programs say they are constitutionally obligated to reach out to women and minorities.
