Mark Ticer, chairman of the Dallas Unauthorized Practice of Law Committee (UPLC), isn’t going to give up his suit against Parsons Technology for selling self-help legal software. Governor George W. Bush had signed a law exempting self-help legal publishers from the unauthorized practice of law statute, causing the 5th U.S. Circuit Court of Appeals on June 29 to vacate an injunction UPLC had won against Parsons. Nevertheless, Ticer argues that Parsons doesn’t qualify for the exemption. “I think basically the gas is out of his tank,” says David Schenk, of Hughes & Luce, the firm representing Parsons. The case is headed back to Senior U.S. District Judge Barefoot Sanders of Dallas, who originally ordered the injunction.
