Brown & Bain has lost a piece of valuable business with Intel Corp. by accidentally filing a suit on their behalf. Intel had put San Jose’s Via Technologies on notice that an expiring cross-licensing agreement would not be renewed because of Via’s failure to comply with the terms of the agreement. In the event negotiations between the two broke down, Intel had prepared a breach-of-contract suit. But someone at the Phoenix-based Brown & Bain thought the complaint was ready to go and filed it with a federal court in April. When Intel finally decided to sue Via recently, it turned to Arnold, White & Durkee to handle the matter. Intel contends that the shift in counsel was not due to Brown’s mistake, but due to a change in nature of the suit.
