Child witnesses or victims do not have the constitutional right to testify in criminal proceedings via videotaped depositions or closed-circuit television, the Pa. Supreme Court has ruled, striking down the 1995 voter-approved amendment to the state Constitution. The case is an issue of first impression and is the first time the state Supreme Court has ruled a state constitutional amendment in and of itself unconstitutional.

The high court ruled that the proposed amendment is unconstitutional because it contained two separate amendments, but allowed voters to vote on them only in the form of one question.
