WASHINGTON � A jury in the Eastern District of Texas has awarded $431.8 million � one of the largest patent infringement awards in the U.S. � to Dr. Bruce N. Saffran, represented by a Dickstein Shapiro legal team. The federal court case, Saffran v. Boston Scientific Corporation, involved alleged infringement of Saffran’s patent on a drug-eluting stent system. After deliberating for one hour and 52 minutes, the jury found in favor of Saffran and awarded exactly the amount of damages he had requested. “The jury clearly found that the case was justified and we are pleased that justice prevailed,” said Gary Hoffman, lead Dickstein Shapiro partner on the case and head of the firm’s Intellectual Property Practice. Hoffman noted that Saffran is an independent inventor and “his contributions to the advancement of medical technology needed to be recognized and rewarded.” The case focused on whether Boston Scientific’s Taxus Express and Taxus Liberte stents infringed on Saffran’s drug-eluting stent patent, which is valid until 2013. More than $3 billion worth of drug-eluting stents are sold each year in the United States, according to Hoffman, and the jury’s decision is tremendously significant because of Boston Scientific’s current 55% market share. Another related lawsuit brought by Saffran is pending against Johnson & Johnson, which until recently was the only other provider of drug-eluting stents. This case also will be heard by U.S. District Judge T. John Ward in the Eastern District of Texas. The legal team, led by Hoffman, included Paul R. Taskier, and James W. Brady, Jr., and local counsel Eric M. Albritton of Longview, Texas.
