WASHINGTON � Maryland Attorney General Douglas Gansler has withdrawn a subpoena for a civil rights lawyer’s computer hard drive and personnel records in an election-related dispute over an attorney’s fee award. The state served the subpoena last spring for the state Board of Elections which has been fighting the fee award since its defeat in 2003 in a ballot challenge brought by the Maryland Green Party. “This a victory for every Marylander who cares about our court system’s respect for the rights of those who stand up to challenge civil rights violations,” said ACLU of Maryland Legal Director Deborah A. Jeon who, with other civil rights groups, sought to quash the subpoena. Gansler’s spokesperson, Raquel Guillory, said the subpoena’s withdrawal had nothing to do with the merits of the fee dispute, but reflected “our desire to move forward at the trial court level” to resolve the estimated $500,000 dispute.
