Click here for the full text of this decision FACTS:Sherrie Lowe used money orders to pay an application fee and security deposit for an apartment. Ownership of the apartment complex transferred to Townview Watersong just three days later. When Lowe returned the next week to move in, she was told that the apartment was not ready. She requested the return of her security deposit. The manager told her she’d be given her deposit back if she didn’t like any other apartments immediately available in the complex. Lowe rejected the other properties, but her deposit was not returned. Lowe sued several entities, including Townview, against whom she raised claims of bad faith, misrepresentation and breach of contract. Townview filed a traditional motion summary judgment raising a limitations defense to Lowe’s bad faith and misrepresentation claims. Townview also filed a no-evidence motion for summary judgment on all of Lowe’s claims. The trial court granted summary judgment without specifying the grounds on which it was based. HOLDING:Affirmed. The court notes that due to the trial court’s grant of summary judgment on unspecified grounds, the burden is on Lowe to establish that each summary judgment ground was insufficient to support the trial court’s judgment. Yet Lowe’s appellate brief does not address any of the no-evidence points. Instead, it addresses the limitations defense and whether the transfer of the security deposit to Townview when it acquired ownership of the apartment complex created a contract between it and Lowe. Despite the failures of Lowe’s argument, the court nonetheless says that it will review Lowe’s point on appeal to the extent that it could be construed as attacking the no-evidence summary judgment grounds. There is nothing suggesting that Lowe had any contact with Townview or that her security deposit was in their possession. Notably, there is no evidence that the manager with whom Lowe said she spoke to was even an employee of Townview or capable of acting in Townview’s behalf.
