CONTRACT Korean computer company Linux One Inc. has sued Foster City, Calif.-based Inktomi Corp. and Sunnyvale, Calif.-based Yahoo! Inc., which acquired Inktomi this month, for rescission, breach of warranty and fraud. Linux One alleges that Inktomi claimed it had developed IP Cache Server software that would work on Linux One operating systems. Linux One entered into a contract with Inktomi under which it paid Inktomi $1 million to license the software for a year. However, Inktomi didn’t disclose that the software didn’t work. Linux One alleges that Inktomi couldn’t make the software work for eight months and that Linux One was only able to make $63,000 in resales in the remaining four months. Linux One Inc. v. Inktomi Corp., No. 5:03-cv-01598 JW ARB (N.D. Calif. April 15). FOR PLAINTIFF: Timothy E. Herr, Herr & Zapala, San Jose, Calif. Source:
