A Second Circuit panel has reinstated a lawsuit accusing a former Fulton County assistant district attorney of misconduct in the prosecution of a domestic violence case, reversing a lower court’s ruling that he was absolutely immune from the suit.

The panel did, however, uphold Matthew E. Trainor’s absolute immunity from the suit’s main claim: that he made false statements that led to the wrongful imprisonment of the plaintiff, Stephanie Flagler.
