A former paralegal at Mueller Law in Austin, Texas, has sued her former employer and its founder, Mark Mueller, alleging they failed to pay overtime for hours she worked in excess of 40 a week, thereby violating the Fair Labor Standards Act.
Allison Luxenberg maintains that as a paralegal, she was a non-exempt employee under the FLSA. The FLSA requires non-exempt employees to receive overtime if they work more than 40 hours a week, she writes in her complaint filed Sept. 19 in the U.S. District Court for the Western District of Texas in Austin. Luxenberg seeks damages and attorney fees.
