A state appeals court on Tuesday overturned a $1.82 million jury verdict in a disability discrimination case, saying the trial judge’s procedural errors “poisoned” the outcome.
Atlantic County Superior Court Judge Joseph Kane mistakenly instructed the jury on reasonable accommodation as a possible basis for recovery even though the suit didn’t plead it.
