A Miami criminal defense attorney who skipped a trial has been located, but what caused him to go missing remains a mystery.

Attorney Michael D. Walsh was scheduled to start a mortgage fraud trial this week before U.S. District Judge James I. Cohn in Fort Lauderdale.

When Walsh didn’t show up for trial Monday or a show cause hearing Tuesday, the judge issued an contempt order and signed a warrant for Walsh’s arrest.

He represents former Plantation police officer Joseph Guaracino, who was indicted in the alleged straw buyer scheme.

Miami solo practitioner Dave Macey, who represents Walsh, said Friday only that his client is “safe” and he didn’t feel comfortable speaking on matters that were personal.
But Macey did say he anticipates Walsh will be representing Guaracino at the trial, which has been rescheduled to commence Monday.

Rumors circulating among lawyers that Walsh was arrested today by the U.S. Marshals Service were not accurate, Macey said.

It’s been a tough spring for Walsh. He was charged March 26 with misdemeanor battery against his estranged wife.

Walsh has represented a number of high-profile clients. At one point, he was the attorney for Tony Villegas, who was charged with killing Rothstein Rosenfeldt Adler partner Melissa Britt Lewis.

Attorney Jordan Lewin, who is representing a co-defendant in the case, said the trial should get underway on Tuesday.
