The lead attorney for New York City and its contractors has challenged orders by Southern District Judge Alvin K. Hellerstein that the lawyer says have inflated the cost of the massive settlement of respiratory claims filed by first responders to the World Trade Center after the 9/11 terror attacks.

James Tyrrell of Patton Boggs argued in papers filed Monday in the Southern District that Judge Hellerstein interfered with the execution of the settlement with his Dec. 30 ruling ordering the involuntary dismissal of claims by 409 plaintiffs who could not be located, failed to respond to communications or refused to respond.
