A Canadian art collector who claims title to a 1,100-pound sculpture by one of the 20th century’s most acclaimed sculptors, Jacques Lipchitz, waited too long to file his court action, a unanimous panel of the Appellate Division, 1st Department, has ruled.

The battle for ownership of Mr. Lipchitz’s “The Cry” pits Hanno D. Mott, the son of Mr. Lipchitz’s widow, Yulla Lipchitz, against collector David Mirvish, who claims title through a companion of Ms. Lipchitz.
