Two months after The New York Times hit OpenAI with a lawsuit alleging copyright infringement, the powerhouse AI startup struck back on Monday, with a motion to dismiss filed in the U.S. District Court for the Southern District of New York.

The AI company asked the court to dismiss four of the the news publisher’s seven claims on the following grounds: expiration of the statute of limitations on the apparent infringement claim; a rejection of the allegation that OpenAI itself contributed to the infringement; a rejection of the claim that OpenAI failed to remove the infringing content; and pushback against the allegation that OpenAI engaged in anti-competitive behavior under state law.
