The U.S. Court of Appeals for the Tenth Circuit partially reversed the grant of summary judgment in favor of a petroleum refiner, finding questions of material fact existed regarding claims for nuisance and negligence per se over a pipeline allegedly leaking onto an Oklahoma ranch.

The court partially affirmed and partially reversed a district court’s order granting summary judgment in Valero Terminaling and Distribution Co.’s favor regarding Lazy S Ranch Properties’ allegation that its pipeline leaked onto the property and polluted the ranch.
