In a case of first impression, the Colorado Court of Appeals established the manner of review for a special motion to dismiss under the anti-SLAPP statute and held, for the first time, that for an administrative proceeding to form the basis of a malicious prosecution claim, it must be quasi-judicial in nature.
According to the opinion, former Deputy Secretary of State Suzanne Staiert and the Public Trust Institute appealed a district court order denying a special motion to dismiss a complaint filed by former state representative, Joseph A. Salazar, under Colorado’s anti-SLAPP statute.
