A Long Island judge has thrown out the racketeering conviction of one of the state's biggest dealers of untaxed cigarettes. In setting aside three of his own previous decisions to uphold the verdict, Eastern District Judge Denis R. Hurley found that a March decision of the Second Circuit, City of New York v. Virginia Seeks Review of Ruling on Prayer

The Supreme Court may decide this week to consider whether the Virginia Military Institute's tradition of pre-dinner prayer violates the First Amendment. The Virginia ACLU has sued on behalf of two cadets, contending the courts shouldn't view the matter differently than prayer in elementary and secondary schools. This is the second time in a decade that a VMI tradition has come before the Court -- the last issue involved women's admittance to the state-run college.

Legal efforts by Native Americans to assert claims to ancestral lands have run into increasing resistance from courts reluctant to undo history. The U.S. Court of Appeals for the Second Circuit delivered the most recent setback by upholding the dismissal of a claim by the Onondaga Nation to 4,000 square miles of upstate New York. The Onondaga suit is the latest to be rejected by the Second Circuit based on a 2005 U.S. Supreme Court decision which held that recognizing a historical right to land is precluded by a long passage of time.
