Salvation Army Accused of Draining Dead Man's Funds

A federal lawsuit alleges that the Salvation Army improperly took more than $120,000 from a dead man's bank accounts -- even though the man had left $106,000 of that amount in the charity's name. According to the complaint, the lawsuit is the first legal challenge to a Florida statute establishing payable-on-death bank accounts. An Ohio appellate court found that a similar statute in that state allowed only people -- not organizations or other entities -- to receive money from such accounts.

Small Miami Firm Raids Ruden McClosky to Open New Office

Seven attorneys from 192-lawyer Ruden McClosky, including the heads of the white-collar and bankruptcy groups, have left to open a new office for Miami's Genovese Joblove & Battista. Departing lawyers say the reason for the move is that Ruden McClosky, which represents nearly every bank and financial institution in Broward County, presents too many conflicts. One headhunter says client conflicts are increasingly prompting lawyers to leave large firms for smaller boutiques, such as the 25-lawyer Genovese.

KeyBank and Bank of America walked out of U.S. Bankruptcy Court in Florida this week with a large chunk of the assets of home-builder Levitt and Sons, which is winding down its operations under Chapter 11 protection. The bankruptcy judge granted motions by the builder to abandon property subject to liens held by two of its largest creditors. The company filed for bankruptcy after failing to restructure $339 million in debt held by five banks.
