The Fourth Appellate District affirmed a judgment. The court held that an employment discrimination plaintiff who failed to challenge on appeal the trial court’s adverse rulings on admissibility of evidence could not rely on that evidence to support the argument that he produced evidence sufficient to withstand summary judgment.

Daniel Villanueva was employed by the City of Colton from 1989 to 1996. He was laid off from the refuse operation in June 1996 then rehired the following month as a probationary operator-in-training in the Wastewater Division. He was promoted to Lead Operator in 2000.
