The court of appeals reversed a district court order and remanded the action for further proceedings. The court held that an actress established a likelihood of irreparable harm in support of her request for a preliminary injunction requiring Google to remove a film from YouTube where she had received death threats and had taken security precautions after the filmmaker fraudulently used her performance in an anti-Islamic film. The court held further that the actress established a likely independent interest in her performance where it fell outside the work for hire doctrine and the fraudulent use of her performance went beyond any implied license that she had given.
