An Illinois judge has dismissed a patent suit in an early test of new, heightened pleading standards for patent infringement cases.

U.S. District Judge Milton Shadur on Tuesday threw out a nonpracticing entity’s suit against Commonwealth Edison Co. over smart meter technology. The judge called it “a hopeless lawsuit of precisely the sort that the last decade’s interpretation of and amendments to the [Federal Rules of Civil Procedure] were intended to dispose of quickly and even to deter outright.”
