The court of appeals affirmed a district court’s preliminary injunction. The court held that the Coeur d’Alene Tribe enjoyed no tribal sovereign immunity, under the Indian Gaming Regulatory Act, against a state’s suit for violation of a Tribal-State Gaming Compact where the Tribe’s offering of Texas Hold’em poker was barred by state law and thus constituted unauthorized Class III gaming.
