The en banc court of appeals affirmed a district court judgment. The court held that an actress was not entitled to a district court injunction requiring that Google remove a controversial film from YouTube where the actress failed to demonstrate that she was likely to succeed on the merits of her copyright claim because she had no protected interest in her brief performance in the film in the first instance. The court held further that the actress, while subject to serious personal risk based on death threats linked to the film, could not show irreparable harm to her copyright-associated interests as an author.
