Lawsuits over Evenflo “Big Kid” booster seats will move forward after a federal appeals court concluded that consumers had standing to sue for economic injuries.

The U.S. Court of Appeals for the First Circuit, on Wednesday, declined to rehear its Nov. 23 decision reviving the multidistrict litigation against Evenflo Co. Inc. Evenflo, on Dec. 16, had petitioned the First Circuit to revisit its decision, which created “a split of authority from numerous other courts of appeals on a question of exceptional importance.”
