Kroger was hit with a consumer class action Tuesday in California Central District Court over the labeling of its store-brand cold and flu medicines. The suit, brought by the Law Offices of Todd M. Friedman and Levi Korsinsky, alleges that Kroger falsely markets certain products as ‘non-drowsy’ and for daytime use when they contain dextromethorphan hydrobromide, an ingredient known to cause drowsiness. Counsel have not yet appeared for the defendant. The case is 2:22-cv-02082, Davis et al v. The Kroger Company.
