Controversy has erupted in the Orange County District Attorney’s Office following a now-fired prosecutor’s unusual disclosure that his boss had made racist comments while discussing whether to pursue the death penalty against a murder defendant.

Ebrahim Baytieh is a candidate for superior court judge who is accused of misconduct in another case. Elected Orange County District Attorney Todd Spitzer said Feb. 9 he fired Baytieh after an outside investigation concluded he illegally withheld evidence in that case.
