The Sixth Appellate District reversed a trial court order. The court held that a party’s request for costs under Code Civ. Proc. §998 was properly presented to the arbitrator following entry of the arbitration award, and the arbitrator should have reached the merits of the request by recharacterizing his final decision as an interim or partial final decision.
