SAN FRANCISCO — The Supreme Court’s Teva v. Sandoz ruling on deferential appellate review is having an impact at the Federal Circuit after all.

In a precedential opinion Tuesday, the U.S. Court of Appeals for the Federal Circuit upheld a $4.5 million judgment for Acacia Research Group subsidiary Lighting Ballast Control LLC. The Federal Circuit had ruled en banc last year that U.S. District Judge Reed O’Connor of Texas misconstrued the patent claims and vacated the judgment. But after being ordered by the U.S. Supreme Court to reconsider under Teva, a three-judge panel reinstated the verdict in Lighting Ballast Control v. Philips Electronics North America.
