SAN FRANCISCO — Acacia Research Group is trying to make lemonade out of a $1.4 million lemon.

The nation’s largest publicly traded patent licensing company is asking the U.S. Court of Appeals for the Federal Circuit to throw out an “exceptional case” attorney fee award obtained by NetApp Inc. last fall. The company argues that patent holders who voluntarily dismiss infringement suits shouldn’t be subject to fee-shifting.
