SAN FRANCISCO — If Sony is still angry at North Korean hackers, maybe it ought to sic Kirkland & Ellis partner David Rokach on them.

Sony Electronics Inc. and Nvidia Corp. asked the Federal Circuit on Monday to uphold a $2 million attorney fee award against nonpracticing entity BIAX Corp. While Nvidia and its counsel at Orrick, Herrington & Sutcliffe focused on affirming Section 285 “exceptional case” fees against BIAX, Sony and Rokach explicitly urged the court to spread the pain to BIAX’s outside counsel, Dorsey & Whitney.
