A medical malpractice defendant does not need to preserve a negligence claim against a dismissed co-defendant in order for the dismissed defendant to be included on a verdict slip, the Pennsylvania Superior Court has ruled.

In a unanimous, unpublished March 1 decision in Drusko v. UPMC Northwest, a three-judge panel upheld a Venango County trial judge’s ruling permitting the inclusion of settling defendant UPMC Northwest on a verdict slip along with nonsettling defendant Dr. Daniel J. Lovestrand in a medical malpractice case.
